https://www.jctourheart.org, its affiliated application and related social media platforms is a project (“Project”) operated by the Jockey Club TourHeart+ (JCTH+) (“We”, “our” and “us”). We are based in Hong Kong, operating under the Department of Psychology, the Chinese University of Hong Kong . Our main address is 326C, 3rd Floor, Sino Building, Department of Psychology, The Chinese University of Hong Kong, Shatin, N.T., Hong Kong.

We will only use your personal information as set out in our privacy policy.

Uploading content to our site

Which country's laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by Hong Kong law. You and we both agree that the courts of Hong Kong will have exclusive jurisdiction.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by Hong Kong law. We both agree to the exclusive jurisdiction of the courts of Hong Kong.

Acceptable Use Policy

As part of the Terms of Service, you agree not to misuse our services (“Services”) or help anyone else to do so. For example, you agree not to do any of the following in connection with our services and/or Project:

  1. use our services/Project for unlawful or unauthorised purposes;
  2. use our services/Project using entities other than the business entity in whose name the account is registered;
  3. re-sell any documents you have gained access to;
  4. re-sell or attempt to benefit in a commercial fashion from any content available as part of the services/ Project;
  5. generate or download documents on a systematic basis that is commercially prejudicial to the services/Project;
  6. sell the services/Project unless specifically authorised to do so;
  7. probe, scan, or test the vulnerability of any system or network;
  8. breach or otherwise circumvent any security or authentication measures;
  9. access, tamper with, or use non-public areas or parts of the services/Project or shared areas of the services/Project that you haven’t been invited to;
  10. interfere with or disrupt any user, host, or network, for example by sending a virus, trojan, worm, logic bomb, or any other material that is malicious or technologically harmful, overloading, flooding, spamming, or mail-bombing any part of the services/Project, or by scripting the creation of any content in such manner as to interfere with or create an undue burden on the Project;
  11. access, search, or create accounts for the services/Project by any means (automated or otherwise) other than our publicly supported interfaces (for example, “scraping” or creating accounts in bulk) or attempt to do so;
  12. send unsolicited communications, promotions or advertisements, or spam;
  13. forge any TCP/IP packet header or any part of the header information in any email;
  14. send altered, deceptive, or false source-identifying information, including “spoofing” or “phishing”;
  15. conduct surveys, contests, or pyramid schemes, or promote or advertise products or services without appropriate authorisation;
  16. abuse referrals or promotions;
  17. post, publish, upload, display, distribute, or share materials that are unlawful, inappropriate, profane, pornographic, obscene, indecent, libelous, defamatory, abusive, or knowingly false, and/or that infringe intellectual property rights;
  18. violate the letter or spirit of our Terms of Service;
  19. violate applicable laws or regulations in any way; or
  20. violate the privacy or infringe the rights of others.

You acknowledge that the above is not an exhaustive list.

This Agreement is made in English and Chinese. In case of any conflict between the English version and the Chinese version, the English version shall prevail.
